![]() I got an email from Florian Seroussi today ?Cizake? stating the same problems. He promised me that if I left my order as is it would ship via UPS at no charge on Monday. I agreed that if he kept his end of the bargain and shipped me a working SIM on Monday and provided me with a tracking number by the end of Monday. I would withdraw my formal complaints to the Delaware and Florida Attorney Generals office, and withdraw my complaint with the respective better business bureaus.
So we will wait and see what happens on Monday. If I have once again been lied to I will post all the appropriate contact information for filing official complaints to assist the rest of you with your issues. |

![]() At this point I think we need to be careful not to be too round in our condemnation. This is obviously a thinly capitalized start-up suffering teething pains. Everyone just "stop and count to ten". If you paid with a credit card, just look at your card's terms and conditions and figure out how long you have left to request the charges be reversed. Let Yackie know that if they don't deliver by some reasonable date (e.g one week before), in order to preserve your rights, you will be reluctantly forced to notify your credit card company. Hopefully this will all work out and we don't end up killing what might actually become a good thing for everyone, provided they are given a chance. If everyone stomps on them all at once, they might just go under.

![]() DRNewcomb, your point is well taken with regards to trying to avoid unnecessay negative comments regarding YM. However, I think people on this forum have a right to express their disappointment - albeit in a controlled manner. First of all, I think it's very unfair to ask the buyers of a product to finance the company selling the product, or the actual product being sold, and I feel like that is what's happening here. Unless, of course, I'm an official investor of the Company receiving the benefits an investor generally receives.
It's also fiscally irresponsible for a company to accept credit card payments (in this case, take your money), and not ship your product. There really is no two ways around that. They are breaking the law (aren't they?). If you send me money and I do not send you product, should you be expected to be patient? You shouldn't be "expected" to. ![]() ![]() Notifying your credit card/bank regarding a fradulent transaction is really not as easy as it seems. Most banks will want to replace your card as procedure, and you'll have to wait one-two-three weeks for a new one to arrive in the mail. This is a real inconvenience for some. I agree that we really shouldn't "condemn" YM, because their potential product is fascinating - I'm really looking forward to it. However, if their early business practices dictate how the company will be run in the future, well I think I'll "run" in the other direction. EDIT: one point that I wanted to add - good customer relations might go a long way to tolerance of startup issues. NO customer relations leads to negativity. If YM happens to be reading, please consider this a constructive criticism. |

Look, I don't want to come across as an apologist for Yackie or whatever...I ordered one about 2 weeks ago and haven't received it yet...like I said I do understand that start up companies can have unforseen problems and right now today I'm not going bonkers over it...I know that if it turns out that this was some kind of fraud, and I at present don't think it is, I will be able to deal with it with the credit card. The product shows some promise and is unique and might prove to be very beneficial....I can certainly wait somewhat longer to give them every opportunity to fulfill their promises. If a month from now, it turns out I haven't received the product I might feel differently. Right now, I really don't see the necessity of hysteria or accusations of fraud. This indeed is the advantage of using a credit card to order things...you always retain a degree of leverage. |

I place an order I expect it to charge the day before it ships like just about every other mail order company. Like with every company you should under promise and over deliver. I didn?t know I had to plan my purchases for travel 2 months in advance. LOL I contacted another company to order a SIM. I placed the order at 3:45PM local time for them and it shipped same day. I received more emails from them with the order status of an in stock shipping product than I have gotten from the other. I don?t think I am being hard on them or creating ?hysteria? like my original post. I told my story and told people to draw there own conclusions. I think they have an awesome product on there hands and it can be a wonderful success for them. Florian Seroussi ?Cizake? and I entered into an agreement on Friday and if all goes well my issues are resolved tomorrow. If they follow through with our agreement I will definitely be posting my happiness with them and not turning my back. I find your defense of them very commendable. ![]() No, no, no, I didn't accuse anybody of fraud nor did I mean to...
Somebody made the point which stuck in my mind that he is very reluctant to do a credit card fraud report because then the card is cancelled...my point was meant to indicate that just because you claim one vendor did not send merchandise does not make it fraud and the credit card itself would not be cancelled. I absolutely and I think if you read the response again did not in the slightest say anybody who would claim a charge back for non receipt was committing fraud. If you got that impression, I most assuredly apologize to you. If you feel the way you do, you are certainly entitled to do what you think is best in this case. I still prefer to wait and give them some more time...nothing irrevocable will happen if I wait up to 60 days that was all I was trying to say. Please please withdraw your accusation that I implied in the slightest that you were committing fraud (or they were committing fraud). |
